(3) Our offer in the online shop is exclusively directed at consumers. Separate conditions of the ZHRILL B2B area apply to entrepreneurs, commercial resellers, and specialist dealers.

(4) The General Terms and Conditions applicable at the time of the order, as retrievable in the online shop, apply to the respective order.

§ 2 Offer and conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an order.

(2) You can initially place the desired products in the shopping cart without obligation. Before submitting your order, you can review and change the selected products as well as your delivery, contact, and payment details.

(3) By clicking the binding order button that completes the ordering process, you submit a binding offer to purchase the products contained in the shopping cart.

(4) Immediately after receiving your order, you will receive an automatic order confirmation by email. This initially only confirms receipt of your order and does not yet constitute acceptance of your offer unless it is explicitly designated as acceptance of the order.

(5) The purchase contract is concluded when we accept your order by a separate acceptance or shipping confirmation via email or ship the ordered goods to you.

If only individual items of an order are accepted or shipped, the contract is only concluded with regard to these items.

(6) For digital vouchers, the contract is concluded when we electronically send the voucher or voucher code or explicitly confirm acceptance of the order to you.

(7) We generally sell products only in household quantities. Orders that are clearly intended for commercial resale may be rejected.

§ 3 Ordering process, input correction, contract text, and contract languages

(1) The order is generally placed in the following steps:

  1. Selecting the desired products,
  2. Adding products to the shopping cart,
  3. Accessing the shopping cart or checkout,
  4. Entering contact, billing, and delivery information,
  5. Selection of the available shipping and payment method,
  6. Review of the order overview and
  7. Submission of the binding order.

(2) Before submitting your order, your order data will be displayed to you again in an overview.

Input errors can be identified and corrected before placing the order using the editing and correction functions provided in the ordering process. You can, in particular, change the quantity of selected items, remove items from the shopping cart, and correct delivery, contact, and payment details.

The ordering process can be canceled at any time before the binding submission.

(3) We store your order and contract data in accordance with legal retention obligations.

After ordering, you will receive a confirmation with the essential order data at the email address you provided.

The General Terms and Conditions applicable at the time of contract conclusion can be accessed before placing the order in the online shop and saved in a reproducible form.

If you have created a customer account, you can view information about your orders there – provided this function is available in the respective customer account.

A permanent provision of the full contract text beyond this via the online shop does not take place.

(4) The languages available for concluding the contract are:

German, English, Dutch, Spanish, French, and Italian.

The language version you selected when placing your order in the online shop is authoritative.

§ 4 Products and Product Presentation

(1) The essential characteristics of the offered products are derived from the respective product description in the online shop.

(2) Product images serve to display the offered goods. Depending on the screen used and its settings, colors may slightly differ from the actual representation.

(3) Information on sizes, fits, and measurements is for orientation purposes. The specific product details and material compositions are derived from the respective product description and the labeling on the product.

§ 5 Prices, Shipping Costs, and Import Duties

(1) The prices stated in the online shop are total prices and include the applicable statutory VAT, if applicable.

(2) In addition to the product price, shipping costs may apply. The applicable shipping costs are shown in the online shop and during the ordering process before you place your order.

(3) The available delivery countries will be displayed to you in the online shop or during the ordering process.

(4) For deliveries to countries outside the European Union, additional import duties, customs fees, taxes, or handling charges by the shipping service provider may apply.

These amounts are not charged by us and must be borne by the recipient according to the legal provisions of the respective destination country.

(5) The prices displayed in the online shop at the time the order is placed apply.

If a product is displayed with an obviously incorrect price due to a technical error, we will not accept your order at that price. In this case, we will inform you and allow you to place a new order at the correct price.

If the correct price is lower than the displayed price, only the lower price will be charged.

§ 6 Payment Methods and Due Date

(1) The payment methods available in the online shop are shown to you during the ordering process.

Which payment methods are offered in each case may depend in particular on the delivery country, order value, the requirements of the respective payment service provider, and the device used.

There is no entitlement to use a specific payment method.

(2) The purchase price is due upon conclusion of the contract, unless a different due date is specified for the payment method you chose.

(3) When using an external payment service provider, the terms of the respective payment service provider also apply. Your legal rights against us are not restricted by this.

(4) If a payment is not made or is subsequently reversed, the legal provisions on payment default apply. Costs may only be charged if they have actually been incurred and are legally reimbursable.

(5) Invoices and credit notes are generally sent electronically to the email address provided during the order.

§ 7 Delivery and Availability of Goods

(1) Delivery is made to the delivery address you provided during the ordering process.

Please carefully check the delivery address before completing your order.

(2) The applicable delivery time is indicated in the online shop, on the product page, or during the ordering process.

Unless a different delivery time is specified there, the delivery time is usually:

  • Within Germany, 2 to 4 business days,
  • For international deliveries, 2 to 8 business days.

Business days in the context of this regulation are Monday to Friday, excluding public holidays at our company’s location.

(3) The delivery period begins the day after payment is received for prepayment. For other payment methods, it begins the day after the contract is concluded.

(4) Partial deliveries are permitted as long as they are reasonable for you. No additional shipping costs will be charged for partial deliveries initiated by us.

(5) If an ordered item is exceptionally unavailable, we will inform you immediately.

If no contract has yet been concluded, we will not accept your order for the unavailable item.

If a contract has already been concluded and we cannot deliver the goods, the statutory provisions apply. Payments already made for the unavailable item will be refunded immediately via the original payment method.

(6) If a shipment is returned to us due to an incorrect or incomplete delivery address provided by you or due to your refusal to accept it, the actual shipping costs incurred for a reshipment may be charged.

This does not apply if you are not responsible for the unsuccessful delivery or were only temporarily unable to accept it, without being properly notified of a renewed delivery.

Your statutory rights of withdrawal remain unaffected.

§ 8 Digital Vouchers

(1) Digital vouchers are sent electronically to the email address provided during the order or to the recipient address you specified.

(2) The conditions stated in the online shop, on the respective product page, and on the voucher apply to the redemption of a voucher.

(3) The voucher can be used to pay for products offered in the ZHRILL online shop.

If the available credit is insufficient to fully pay for an order, the remaining amount can be paid using another payment method offered during the ordering process, provided this is technically possible.

(4) Cash payment of the voucher value is excluded unless mandatory legal provisions state otherwise.

(5) The statutory rights of withdrawal and warranty remain unaffected.

(6) The statutory withdrawal provisions apply to the online purchase of digital vouchers. In the event of a valid withdrawal, an unused voucher code will be deactivated. Legal claims related to a voucher that has already been redeemed are governed by the applicable statutory provisions.

§ 9 Retention of Title

The delivered goods remain our property until full payment of the purchase price.

§ 10 Right of Withdrawal

Consumers generally have the statutory right of withdrawal.

Details on the conditions, deadlines, and consequences of withdrawal, the costs of return shipping, the electronic withdrawal function, and the sample withdrawal form can be found in our separate cancellation policy.

The cancellation policy can be accessed in the online shop on the "Right of Withdrawal" page.

§ 11 Statutory Warranty

(1) The statutory warranty rights apply to the goods and digital vouchers we deliver.

(2) If the delivered goods are defective, you may, in accordance with statutory provisions, in particular demand subsequent performance.

In addition, you may have the right to reduce the purchase price, withdraw from the contract, and claim damages if the legal requirements are met.

(3) Additional guarantees exist only if they are expressly stated for the respective product. Your statutory warranty rights are not limited by a guarantee.

(4) Should you receive goods with obvious transport damage, we ask you to report this to the carrier as soon as possible and to contact us.

If you fail to do so, this has no effect on your statutory claims. The notification merely helps us to assert our own claims against the transport service provider.

§ 12 Liability

(1) We are liable without limitation for damages resulting from intentional or grossly negligent breaches of duty by us, our legal representatives, or vicarious agents.

(2) In the event of damage resulting from injury to life, body, or health, we are liable without limitation even in cases of simple negligence.

(3) In the case of a slightly negligent breach of an essential contractual obligation, our liability is limited to the typical contractual and foreseeable damage at the time of contract conclusion.

Essential contractual obligations are those obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the contracting partner may regularly rely.

(4) Otherwise, liability for slightly negligent damages is excluded.

(5) Liability under the Product Liability Act, from an expressly assumed guarantee, for fraudulently concealed defects, and under other mandatory statutory provisions remains unaffected.

§ 13 Consumer Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Applicable Law

(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

(2) If you are a consumer and have your habitual residence in another country, this choice of law does not deprive you of the protection granted to you by mandatory provisions of the law of your habitual residence.

§ 15 Final Provisions

(1) Individual agreements between you and us take precedence over these General Terms and Conditions.

(2) Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the statutory provisions shall apply in its place. The validity of the remaining provisions shall remain unaffected.
